Cobb Man Gets 65 Years in CVS Kidnapping, Rape Case

The father of the victim addressed the court during Wednesday’s sentencing hearing, and asked that Darrious Mathis be severely punished.

Cobb Assistant District Attorney Chuck Boring, who prosecuted the case with fellow ADA Sherwin Figueroa, also urged Cobb Superior Court Judge Lark Ingram to impose a harsh sentence.

“Anyone capable of doing what Mr. Mathis did forfeits their right to live in a free society,” Boring said. He also lamented the defendant’s refusal to take responsibility for the crime, as evidenced by “his insulting, arrogant, ridiculous testimony” at trial in claiming that the encounter was consensual. 

During the trial, surveillance video from the CVS store showed Mathis crouching behind a trash can near the entrance to the store as the victim, then 24, entered the store in the early-morning hours of Oct. 25, 2011, and then exited after making a purchase. She had just gotten off work.

The video then shows Mathis quickly approach the woman, who gets in the driver’s seat while Mathis got in the back seat of the vehicle behind her. They then drove away.

The victim tearfully told jurors that Mathis had a small revolver, and that she was so frightened, she wet her pants when he forced her into the car. She said that Mathis forced her to drive into Atlanta near Greenbriar Mall, where he sexually assaulted her, and that he then made her drive to several ATMs until she could get money out of her bank account.

DNA and other physical evidence corroborated her account of the attack.

Mathis was convicted on March 25 of the crimes that took place in Cobb County, including kidnapping, hijacking a motor vehicle, aggravated assault, and possession of a firearm during commission of a felony.
