Man Robs ATM Patron, Gets 40 Years in Jail

A Marietta man has been convicted of the armed robbery aggravated assault of a 59-year-old man outside of an ATM in Smyrna.

Derrius Shamar McKinney, a/k/a Barn was convicted of the crime, which took place on Sept. 13, 2012 at the Bank of America ATM at 2475 South Cobb Drive shortly before 9 p.m.

DNA found on cigarettes near the victim matched that of Mr. McKinney. The victim was hit in the head with a gun and robbed of $160.

Jurors acquitted Mr. McKinney, 23, of Marietta, of another armed robbery and aggravated assault that occurred at the same ATM a week earlier. None of the victims in either robbery were able to identify the perpetrators because of the night darkness and poor lighting.

Assistant District Attorney Maurice Brown said Mr. McKinney, along with a codefendant, were trying to get something for nothing.

“That goes against the American way,” Brown said. “You can’t expect to deprive hard-working Americans of the fruits of their labor and not suffer the consequences.”

This morning, Cobb Superior Court Judge Mary E. Staley sentenced Mr. McKinney to the state’s recommendation of 40 years.
