Zaxby's Murder Suspects Face New Charges

According to arrest warrants, the men were allegedly transporting "marijuana for the purpose of distribution."

Three people in the Cobb County Adult Detention Center without bond in connection with a fatal shooting outside of a Smyrna-area Zaxby's face new charges.

In addition to murder, Desmond Deaundray Mosby, 27, of Smyrna; Gershom Joshua Brown, 27, of Marietta; and Kemanie Kyle Rhaburn, 29, of Los Angeles, each face one count of marijuana distribution.

According to arrest warrants, the men were allegedly transporting "more than one ounce of marijuana for the purpose of distribution" when Jarvis McNabb was shot twice in the parking lot of the Zaxby's at 5201 South Cobb Dr. about 8:30 p.m. Wednesday, according to warrants.

McNabb, 29, of Marietta, was pronounced dead at WellStar Kennestone Hospital, Cobb police Sgt. Dana Pierce said Thursday.

"Moments after the crime," he said, "witnesses reported seeing one male flee on foot and two other males flee onto South Cobb Drive in what was described as a red compact 4-door car."

Cobb police arrested Rhaburn late Wednesday at the intersection of South Cobb Drive and North Church Road, according to online jail records.

Investigators with the Cobb County Sheriff’s Office Fugitive Unit and the U.S. Marshals Fugitive Task Force arrested Mosby and Brown about 2 p.m. Thursday, Cobb Sheriff Neil Warren said Thursday evening.
